Terms and Conditions

Scope of application

The following terms and conditions apply to all orders via our online shop by consumers and entrepreneurs.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity. Entrepreneur is a natural or legal person or a partnership with legal capacity, which acts in exercise of its commercial or independent professional activity when concluding a legal transaction.

In relation to entrepreneurs, these General Terms and Conditions shall also apply to future business relations without us having to refer to them again. If the entrepreneur uses conflicting or supplementary General Terms and Conditions of Business, their validity is hereby contradicted; they shall only become part of the contract if we have expressly agreed to them.

Contracting party & conclusion of contract

The purchase contract is concluded with Wexim GmbH.

By placing the products in the online shop, we make a binding offer to conclude a contract for these articles. You can initially place our products in the shopping basket without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained in the order process. The contract is concluded when you accept the offer for the goods contained in the shopping basket by clicking the order button. Immediately after sending the order, you will receive another confirmation by e-mail.

Newsletter

When concluding a contract, the occasional sending of product-related newsletters is permitted in accordance with § 7 Para. 3 UWG, insofar you do not object to the use of your e-mail address for this purpose. You can of course object to the use of your e-mail address for advertising purposes at any time.

3rd contract language, contract text storage

The languages available for the conclusion of the contract are German and English.

We save the text of the contract and send you the order data and our general terms and conditions by e-mail. You can also view the T&C at any time here on this page. For security reasons, your past orders are no longer accessible via the Internet.

Terms of delivery

Shipping costs are added to the stated product prices. You can find out more about the amount of the shipping costs in the offers.

In principle, you have the option of picking up your order at Wexim GmbH, Porschestr. 11, 12107 Berlin, Germany during the business hours (Monday to Friday from 10:00 to 17:00 - except on public holidays). Please inform us at least one working day before your pickup so that we can make the goods available from our warehouse. You can also pay here by EC card.

We do not deliver to packing stations.

Payment

In our onlineshop you can choose between the following payment methods:

Payment in advance

If you choose the payment method prepayment, we will give you our bank details in a separate e-mail and deliver the goods after receipt of payment.

Credit card payment by Stripe

When you place your order, you send us your credit card details at the same time. After your legitimation as a legitimate cardholder, we will request your credit card company to initiate the payment transaction immediately after the order. The payment transaction is automatically carried out by the credit card company and your card is debited.

PayPal, PayPal payment by instalments

During the ordering process you will be redirected to the website of the online provider PayPal. In order to pay the invoice amount via PayPal, you must be registered there or first register, authenticate with your access data and confirm the payment order to us. After placing the order in the shop, we will ask PayPal to initiate the payment transaction. You will receive further instructions during the ordering process.

The payment transaction will be carried out automatically by PayPal immediately afterwards.

Klarna

In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer the following payment options. The payment is always made to Klarna:

Invoice: The payment period is [14] days from dispatch of the goods/tickets/ or, in the case of other services, the provision of the service. The complete invoice conditions for the countries where this payment method is available can be found here: Germany, Finland, Great Britain, Netherlands, Norway, Austria, Sweden, Switzerland.

Instalment purchase: Klarna's financing service allows you to pay for your purchase in fixed or flexible monthly instalments under the conditions specified in the checkout. Payment in instalments is due at the end of each month after Klarna sends you a monthly invoice. For more information on instalment purchases, including the General Terms and Conditions and Standard European Consumer Credit Information for countries where this payment method is available. Only available in the countries indicated: Austria, Denmark, Finland, Germany, Great Britain, Norway, Sweden.

Sofortüberweisung: Available in Germany, Austria, Belgium, Italy, Spain, Poland, Netherlands and Italy. Your account will be debited immediately after placing the order.

Direct debit: The direct debit is made after the goods have been shipped. You will be informed of the time by e-mail.
Credit card (Visa/Mastercard): Available in Germany. The debit is made after dispatch of the goods or tickets / availability of the service or in case of a subscription according to the communicated times.

Reservation of proprietary rights

The goods remain our property until full payment has been received.

For entrepreneurs, the following applies additionally: We reserve the right of ownership of the goods until all claims from an ongoing business relationship have been settled in full. You may resell the goods subject to retention of title in the ordinary course of business; you assign to us in advance all claims arising from this resale - irrespective of any combination or mixing of the goods subject to retention of title with a new item - in the amount of the invoice amount, and we accept this assignment. You remain authorised to collect the claims, however, we may also collect claims ourselves if you do not meet your payment obligations.

Transport damage

If goods are delivered with obvious transport damages, please complain about such defects to the deliverer as soon as possible and contact us immediately. Failure to make a complaint or contact us will not have any consequences for your legal claims and their enforcement, especially your warranty rights. However, you help us to be able to assert our own claims against the carrier or the transport insurance company.

Warranty and guarantees

The statutory law on liability for defects shall apply. Should the article description contain a guarantee reference, then we, Wexim GmbH, will in any case stand up for the guarantee services. We are your first point of contact, even if, for example, a manufacturer's warranty is mentioned. The duration of the guarantee is stated in the product description and begins upon receipt of the goods.

The guarantee refers to the freedom from defects of the respective product, including functionality, material or production defects.

In case of warranty:

If you have a warranty case, please send us the goods with all documents in the original (sales slip/receipt with date, if necessary warranty papers of the manufacturer), as well as a problem report.

Your legal rights (i.e. "liability for defects") are not limited by this dealer warranty. In addition to the legally existing warranty, you will receive this warranty (dealer warranty) from us, Wexim GmbH. The dealer warranty does not therefore violate your legal rights, but rather extends your legal position. The territorial scope of the warranty protection is Europe-wide.

Liability

For claims based on damages caused by us, our legal representatives or vicarious agents, we are always liable without limitation

  • in case of injury to life, body or health,
  • in case of intentional or grossly negligent breach of duty,
  • in the case of guarantee promises, if agreed, or
  • insofar as the scope of application of the Product Liability Act is opened up.

In the event of a breach of material contractual obligations, the fulfilment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, on the part of our legal representatives or vicarious agents, liability shall be limited in amount to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.

Data protection regulations

With regard to the processing and storage of your data, please read our current data protection regulations, in accordance with the basic data protection regulation (DSGVO), which came into force on 25.05.2018.


Dispute resolution

The European Commission provides an Online Dispute Resolution (OS) platform, which you can find here. We are not obliged but willing to participate in dispute resolution proceedings before a consumer dispute resolution service.
